Terms of Use – Viapa AI

By using Viapa AI, you agree to these Terms of Use.

1. Acceptance of These Terms

By downloading, accessing, or using the Viapa mobile application (the “App”) or any related services (together, the “Services”), you agree to these Terms of Use (“Terms”).

If you do not agree, please do not install or use the App.

These Terms apply to users on iOS (Apple App Store) and Android (Google Play Store).

2. App Store & Google Play Disclaimer 

This agreement is between you and Viapa, not Apple Inc. or Google LLC.

  • Apple and Google are not responsible for the App or its content

  • Apple and Google have no obligation to provide support for the App

  • Any claims relating to the App must be directed to Viapa, not Apple or Google

Apple and Google are third-party beneficiaries of these Terms and may enforce them where applicable.

3. About Viapa and the App

Viapa is a technology and AI-powered orchestration platform designed to assist users with digital interactions, workflows, and payment initiation through integrations with third-party providers.

Important Non-Custodial Notice

  • Viapa does not hold customer funds

  • Viapa does not store payment card details

  • Financial transactions are handled by regulated third-party providers

4. Eligibility & User Responsibilities

You confirm that:

  • You meet the minimum legal age required in your country

  • You have the legal capacity to accept these Terms

  • You will use the App only for lawful purposes

You are responsible for:

  • Maintaining the confidentiality of your account

  • All activity that occurs under your account

5. AI Features Disclosure 

Viapa includes AI-powered features intended to assist users.

You acknowledge that:

  • AI responses are automated and informational

  • AI outputs may be inaccurate or incomplete

  • AI does not provide professional, legal, financial, or medical advice

  • You remain responsible for decisions made based on AI output

Viapa uses human oversight and does not allow AI to make irreversible decisions without review.

6. Acceptable Use

You agree not to:

  • Use the App for illegal, harmful, or fraudulent activities

  • Attempt to bypass security or access unauthorized data

  • Upload malicious code or harmful content

  • Use AI features to impersonate others or generate deceptive content

We may suspend or terminate access if these rules are violated.

7. Payments & In-App Purchases

  • Payments, subscriptions, or in-app purchases (if applicable) are processed through third-party payment providers

  • Viapa does not control app-store billing processes

8. Intellectual Property

All content and software within the App belong to Viapa or its licensors.

You may not:

  • Copy, modify, reverse-engineer, or redistribute the App

  • Use Viapa branding without permission

9. User Content

If you submit content through the App:

  • You retain ownership

  • You grant Viapa a limited license to use it to operate and improve the Services

You are responsible for ensuring your content complies with the law.

10. Privacy & Data Use

Your use of the App is governed by our:

  • Privacy Policy

  • Cookie Policy

  • Data Processing Addendum (where applicable)

These documents explain how we collect, use, and protect your data.

11. App Availability & Updates

Viapa may:

  • Update the App automatically or manually

  • Add, remove, or change features

  • Temporarily suspend access for maintenance

We do not guarantee uninterrupted availability.

12. Termination

You may stop using the App at any time.

Viapa may suspend or terminate access if:

  • You violate these Terms

  • Required by law or regulation

  • Necessary to protect users or the platform

13. Disclaimers

The App is provided “as is” and “as available.”

To the extent permitted by law, Viapa disclaims all warranties, including implied warranties of merchantability and fitness for a particular purpose.

14. Limitation of Liability 

To the extent permitted by law, Viapa is not liable for:

  • Indirect or consequential damages

  • Loss of data or profits

  • Errors from third-party services or AI output

Total liability will not exceed the amount you paid (if any) for the App in the last 12 months.

15. Indemnification

You agree to indemnify Viapa from claims arising from:

  • Your misuse of the App

  • Your violation of these Terms

  • Your violation of laws or third-party rights

16. Governing Law

These Terms are governed by applicable local law, without regard to conflict-of-law principles.

17. Changes to These Terms

We may update these Terms from time to time.

Continued use of the App after updates means you accept the revised Terms.
